1. Accepting these terms

These Terms of Service (“Terms”) govern your use of www.callowayplumbing.example and its quote form (the “Site”), operated by Calloway Plumbing Co. (“we,” “us” or “our”). By using the Site you agree to these Terms and to our Privacy Policy and Disclaimer. If you do not agree, do not use the Site.

2. Who may use the Site

You must be at least 18 years old and able to enter into contracts to request a quote. If you request a quote for a property you do not own, you confirm that you are authorized by the owner to do so.

3. Quote requests, estimates and contracts

• Submitting a request does not obligate you to buy anything and does not obligate us to perform any work.
• Fixture counts, pipe lengths and ballpark price ranges shown on the Site are automatic estimates based on your answers. They are not offers, bids or guarantees, and actual prices can differ significantly.
• Prices, materials, schedules and warranties are set only in a written estimate or contract you approve after we see the job. That document, including any rights you have under California law such as cancellation rights, controls over anything on the Site.
• If a visit carries a diagnostic, trip or after-hours fee, we tell you the amount before we come out, and whether it is credited toward the repair. You are never charged for work you did not approve.
• Availability, arrival times and emergency response described on the Site are goals, not guarantees. Traffic, call volume, permits, inspections and parts availability can affect them.

4. Calls, texts and emails

When you submit a request, you agree that we may contact you by phone, text message and email at the information you provide about your request and project, which may include messages sent with automated technology. Message and data rates may apply. Reply STOP to stop texts and HELP for help. Consent is not a condition of purchase. See our Privacy Policy for details.

5. Maintenance plans and automatic renewal

Plans renew automatically until you cancel. When you sign up for a maintenance plan, you authorize us and our payment processor to charge the price shown for your plan at the frequency you choose (for example, once, twice or four times a year), starting on the date you sign up and continuing until you cancel. The plan name, price per visit, number of visits per year and billing schedule are shown before you pay and on your receipt.

• Cancel anytime by calling (916) 555-0187, emailing office@callowayplumbing.example, or using the cancel or manage link in your payment receipt. Cancellation stops future charges. You can cancel online the same way you signed up.
• Charges for visits already completed are not refunded. If you cancel after paying for a visit that has not happened yet, we will refund that visit.
• We will tell you about any price change at least 30 days before it applies, and you can cancel before it takes effect.
• We send a reminder before each visit. Visits may be rescheduled for weather, safety or access. If we cannot complete a visit you paid for, we will reschedule it or refund it.
• Plans cover the maintenance described for that plan. Repairs, replacements or other work we find are quoted separately and done only with your written approval.
• We may decline or end a plan if equipment is unsafe to service or needs repairs before maintenance can be done, for example a leaking water heater or a collapsed sewer line. Any prepaid, unperformed visits will be refunded.

Payments are processed by a third-party payment processor under its own terms. We never see or store your full card number.

6. Your submissions and photos

You confirm that the information you submit is accurate and that you have the right to share any photos you upload. You grant us a non-exclusive, royalty-free license to use your submissions and photos to evaluate your property, prepare estimates and insurance documentation, and provide our services. We will not use photos that identify you or your property in our marketing without your permission.

7. Acceptable use

You agree not to:

• submit false, misleading or someone else’s information, or impersonate anyone;
• use the Site for any unlawful purpose or to harass anyone;
• send spam, malware or automated requests, or interfere with the Site’s security or operation;
• scrape, copy or harvest content or data from the Site by automated means;
• use the Site to compete with us or to collect information about our customers.

8. Our content

The Site and its content, including text, design, graphics, drawings, photos, logos and code, belong to us or our licensors and are protected by copyright, trademark and other laws. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission. Manufacturer names and trademarks belong to their owners.

9. Reviews and testimonials

Reviews and testimonials reflect the individual experiences of the people who wrote them. They are not a guarantee that you will have the same experience or results.

10. Third-party services and links

The Site may link to or rely on services we do not control, such as maps, review sites, payment or financing providers, and social networks. We are not responsible for their content, availability or practices, and your use of them is governed by their terms.

11. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES ABOUT THE SITE, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.

This section applies to the website only. Warranties for plumbing work, fixtures and equipment are provided solely in your written contract and by the manufacturers.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR RELIANCE ON ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SITE IS LIMITED TO ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be limited by law or changes the terms of a signed plumbing contract.

13. Indemnification

You agree to defend, indemnify and hold us harmless from claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site, your violation of these Terms, or information or photos you submit that you did not have the right to share.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing any claim about the Site, you agree to contact us and try to resolve it informally for at least 30 days. Any claim that is not resolved will be brought only in the state or federal courts located in Sacramento County, California, and you consent to their jurisdiction. Disputes about plumbing work are governed by the dispute terms in your written contract.

15. General

• We may update these Terms by posting a new version on this page with a new effective date. Continued use of the Site means you accept the update.
• If any part of these Terms is found unenforceable, the rest stays in effect.
• Our failure to enforce any part of these Terms is not a waiver.
• These Terms, the Privacy Policy and the Disclaimer are the entire agreement between you and us about the Site.
